Precious Fur Service Agreement
1. Agreement: This service agreement (“Agreement”) is entered into as of the date of service agreement first captured by the scheduling portal, between 8086 Sitting Corp., dba Precious Fur, or Precious Fur Cat Sitting (“Precious Fur”) and the Client (“Client”). For adequate consideration, Precious Fur and Client agree as follows.



2. Keys: Client authorizes Precious Fur to enter Client's home and surrounding premises (“Home”) to perform services for the benefit of Client and Client's cat or other designated animal (“Pet”). Precious Fur requires a minimum of TWO working keys for each Home. It is the responsibility of Client to pass along Precious Fur's information to such contacts holding spare keys, and to confirm that contacts holding spare keys are available during the time of Precious Fur's service. Unless keys are provided upon initial interview, a key transfer charge at the posted rate will be added to every service that requires a key transfer. If Precious Fur is required to make a duplicate, a key copy charge will apply at the posted rate.



3. Rates and Services: Precious Fur agrees that its staff will provide such loving care as indicated in this Agreement for the cat or other pet animals listed and owned by Client (“Pet”). Current rates and services are displayed on website www.preciousfur.com. If Precious Fur changes the prices on its website, those changes will apply going forward but not retroactively.



Precious Fur has a minimum visit policy to comply with our insurance policy and for the health and well-being of our Client's Pets. Precious Fur will visit Client's Pet, at a minimum, every 24 hours. Visit times are approximate and subject to change based on the needs of all the animals under Precious Fur's care. Precious Fur is entitled to use its reasonable judgment in caring for Pet. Supplemental invoice is payable in full on the first day of the sit.



Client authorizes Precious Fur to use its reasonable judgment in maintaining a comfortable temperature for the safety and comfort of Pet. In performing the agreed upon services, Precious Fur will use its own judgment and reasonable efforts to care for Client's Pet and deliver other agreed upon services (e.g. mail collection, newspaper retrieval, watering plants).



4. Optional, Additional Services, Provided on an “As-Is” Basis: The following services (“Optional Services”) may be provided, at Client's request and if Precious Fur agrees, however on a different basis than the services described in section 3. Namely these Optional Services are provided on an “as is” basis, at the posted rates, and Precious Fur undertakes no liability by providing them. Moreover, if and to the extent Client asks for an Optional Service, Client hereby indemnifies, and promises to defend and hold Precious Fur harmless from any claim from any person arising from or related to Precious Fur's provision of the Optional Service, whether due to Pet, or circumstance in the Home, or Client or otherwise. In providing the Optional Services, Precious Fur may exercise its maximum discretion. The Optional Services are as follows.



a. At Client's request, and under extenuating circumstances in which a second key has not been given to Precious Fur, Client will provide additional door codes, landlord contact information or contact information of persons with duplicate keys whom Precious Fur can contact.



b. At Client's request, Keys may be accepted in unsecure locations (including in a personal lockbox or otherwise hidden). Client agrees that Client will be responsible for any liability or costs associated with keys left in unsecure places, including but not limited to locksmith costs related to lost keys or unlawful activity by anyone aside from Precious Fur.



c. At Client's request, Precious Fur may agree to lock keys inside the Home on last visit. If additional service is required after the last day of service when keys are locked inside the Client's Home, Client will be responsible for alerting Client's contacts holding a spare key and will ask them to coordinate drop off to Precious Fur. If Precious Fur is required to employ a locksmith to gain entry into Client's Home due to a malfunction of the lock or a failure by Client to leave the key, or in the event the key has been locked inside the Home at the request of Client, it will be the responsibility of Client to reimburse for all cost incurred, including the cost of Precious Fur's time, charged per hour at the posted rate. Without limitation, the Client gives Precious Fur the authority to employ a locksmith on Client's behalf in the event of the aforementioned Optional Services and will pay for them.



d. Other Optional Services, which are subject to a supplemental invoice, include but are not limited to picking up supplies (food, treats, medications etc.), taking Client's Pet to the vet, extensive incidental clean-up of Client's Home, any emergency in Client's Home (including waiting for service person), and any payment by check.



e. At Client's request, Precious Fur may agree to exercise, walk or allow Pet outside Client's Home. If the Pet escapes through no fault of Precious Fur, time spent retrieving the Pet will be payable at the posted rate.



f. At Client's request, Precious Fur may allow Client to have another contact care for the Pet during the service period. Precious Fur accepts no responsibility if Client chooses to allow a contact, whether paid or not, to share in responsibility for the Pet, including without limitation feeding or medicating the Pet. Moreover, Precious Fur accepts no responsibility for security of the Home, damages or loss if other individuals have access to Client's Home or if the Home is not properly secured through no fault of Precious Fur.



5. Unexpected Services: The parties recognize that unexpected problems may arise. Client authorizes Precious Fur to deal with the problems described in this section (“Unexpected Services”) however Precious Fur deems fit. Unexpected Services are on an “as is” basis. Client furthermore agrees to indemnify, defend and hold Precious Fur and its employees harmless from any claim or expense arising from Unexpected Services.



a. If a locksmith is needed, Precious Fur may hire one at Client's expense.



b. If there is any emergency involving the Home, Client hereby authorizes Precious Fur to obtain the following services: alarm system, electrician, plumber, HVAC, sprinkler service, maintenance/grounds, and septic system. To the extent they are deemed needed at the time, Client will be responsible for all such vendor charges.



c. If Precious Fur personnel are bitten or scratched or otherwise exposed to any disease or ailment received from Client's Home or Pet or any other animal in the Home, it will be Client's responsibility to pay all costs and damages incurred by the victim. Client has suitable insurance to cover any injury to Precious Fur due to Client's Pet or Home.



d. In there is an emergency involving the health of any Pet, Precious Fur will promptly notify Client through contact information provided in this Agreement. If Client cannot be reached, or if Client is reached and requests it, Client hereby authorizes Precious Fur to obtain such veterinary treatment as stated in the Veterinary Authorization Form. If no Veterinary Authorization Form has been signed, Client authorizes Precious Fur to use its best judgment in authorizing care for the Pet.



6. Payment Policy: Payment is due when services begin unless otherwise agreed in writing. If payment is not received at time of services, Precious Fur reserves the right to charge a late payment fee at the posted rate until payment is received in full, beginning with the date services began unless otherwise stated on invoice. “Payment” will mean the actual receipt of payment by Precious Fur. Payments are only accepted through the Precious Fur System (ACH or credit card). Payment options can change at any time, as listed on www.preciousfur.com.



7. Cancellation Policy: Client agrees to notify Precious Fur if Client is delayed or early returning to Client's Home. Client further agrees to pay for any additional visits required, or any visits made if not notified 24 hours in advance of the Client returning Home early. Pet Sitting by the Hour services cancelled less than 24 hours from the time the service is scheduled to be performed will receive no refunds or credits for the visit scheduled for that day; this is including but not limited to miscommunications from Client on when services should begin and end, and unexpectedly late departures by Client from the Home. Over Night services are subject to a 7 day cancellation period, and Live-In Pet Sitting services are subject to a 14 day cancellation period. Cancellation period is determined by counting back from the date services are scheduled to begin. If reservations are cancelled prior to the applicable cancellation period, Client will not be charged. Otherwise, Client will be responsible for 50% of the cost of the cancelled Over Night or Live-In Pet Sitting Service total. Reservation extensions are subject to a supplemental invoice and will be billed upon Client's return.



8. Shared Responsibility/Trespassers: Client agrees to provide and list all individuals and companies who have access to Client's Home while Client is away (e.g. house cleaning service, painters, landscapers, friends, family members, etc.) prior to service period. Precious Fur will not be held responsible for the acts of others who are allowed in and out of the Home during the service period or who through crime or negligence or otherwise get access to the Home.



9. Emergency Services: Client will give a written list of preferred service companies for the types of services listed below. If a specified company is unavailable or Client does not provide any preferred companies, Client authorizes Precious Fur to select a company of their choice. Client further authorizes Precious Fur or its representatives to incur cost in the name of Client. Client explicitly states they will be responsible for any cost incurred. Client agrees to indemnify and holds harmless Precious Fur from any liability arising from such charges. Client agrees to pay House Emergency Charge to Precious Fur at a rate equivalent to the rate of a one hour visit, charged per hour. Precious Fur is not responsible for any service fees charged by alarm companies, police departments, or any other entity due to false alarm, malfunction, or accidental triggering of the alarm.



10. Continuing Obligations: It is understood and agreed between Client and Precious Fur that this Agreement contemplates Client may be in need of Precious Fur services from time to time in the future, and is further understood and agreed that the obligations and covenants contained in this Agreement will apply to each provision of products and/or services in the future, without the need of entering into another agreement, unless altered by both parties in writing. As further consideration for the services rendered, Client agrees to waive and release Precious Fur and its representatives from any claim for injury to and/or death of Client's Pet as and from any claim for injury, loss or damage to Client's Home. In the event of the hiring of new employees and/or independent contractors to work for Precious Fur, or the incompatibility, personal emergency, illness, injury or unavailability on the part of the Precious Fur, Client authorizes Precious Fur to arrange for another qualified individual to fulfill the responsibilities set forth by Precious Fur.



11. Bad Weather/ Natural Disaster: In the event of an extremely bad weather day or natural disaster, Precious Fur will make pet sitting rounds as soon as it is safe to travel. Precious Fur is entrusted to use its best reasonable judgment in caring for Pet. Client will not hold Precious Fur liable for consequences related to such decisions.



12. Pets with Outside Access: Precious Fur under no circumstances will be held liable for injury, disappearance, death or fines incurred regarding Pets that have available access to the outside. Client authorizes Precious Fur to buy emergency veterinarian care for those Pets as Precious Fur or its representative may deem necessary. Client further authorizes Precious Fur or its representatives to incur veterinarian cost in the name of Client. Client will be responsible for any veterinary cost incurred. Client agrees to indemnify and hold harmless Precious Fur from any liability arising from such veterinary charges.



13. Contract Termination: Precious Fur reserves the right to terminate this Agreement at any time before or during its term if Precious Fur in its sole discretion, determines that Client's Pet or Home poses a danger to the health or safety of Precious Fur personnel. If concerns prohibit Precious Fur from caring for Pet, Client authorizes Pet to be placed in a kennel, with all charges paid by Client.



14. Photo Release: Precious Fur or its agents have the right to take photographs, videotape, or digital recordings of Pet and to use these in any and all media for the purpose of marketing and business development. Precious Fur will not post Client pictures or any information to social media in real time for security reasons, nor include any identifying features of the Home or surrounding area. Client hereby grants Precious Fur and its agents all rights to exhibit this work in print and electronic form publicly or privately, and waives any rights, claims, or interest Client may have to control the use of Pet's likeness in any media recorded by Precious Fur. There will be no financial or other remuneration for such use, either for initial or subsequent transmission or playback.
